Bramble Terms of Service
The short version
- Your recordings are yours. Every video, transcript, and clip belongs to you. Exporting your original footage is free — forever, subscription or not.
- Bramble is a subscription ($48.99/year or $9.99/month through Apple, after a free trial period). Apple handles billing and cancellation.
- Bramble offers conversation prompts, not professional advice. Our questions are informed by child-development research, but Bramble is not a medical, psychological, or developmental tool, and it doesn’t diagnose or treat anything.
- Be a grown-up about it. Record your own kid (or with a guardian’s permission), use the app lawfully, don’t try to break it.
- We provide the app as-is. A small app for family moments comes with honest, ordinary limits on warranties and liability.
These terms are an agreement between you and the maker of Bramble. By downloading or using the Bramble iOS app or askbramble.com (together, “Bramble”), you agree to them. If you don’t agree, please don’t use Bramble.
1. Who can use Bramble
You must be at least 18 and a parent or legal guardian (or an adult recording with a parent or guardian’s permission). Bramble is a tool for adults; children may appear in your recordings, but they are not users of the app and may not operate it.
2. Your license to use Bramble
We grant you a personal, limited, non-exclusive, non-transferable, revocable license to install and use Bramble on Apple devices you own or control, for your personal, non-commercial family use, in line with these terms and Apple’s App Store terms. We keep all rights not expressly granted. You may not copy, modify, resell, rent, reverse-engineer, or extract the source code of the app, or use Bramble to build a competing dataset or service, except where the law says we can’t stop you.
3. Your content is yours
This one matters most, so plainly:
- You own all of it. Your videos, audio, transcripts, edited clips, memory notes, and exports are yours. We claim no ownership, ever — during your subscription, after it lapses, and after you delete the app.
- Raw export is free, forever. Exporting your original, unedited recordings never requires a subscription and never will. Your family’s moments are not held hostage to a paywall.
- The only license you give us is the one needed to make the app work. If you turn on the optional AI features, you grant us (and our processors, AssemblyAI and Anthropic, as described in the Privacy Policy) a limited, revocable permission to process your recordings’ audio and transcripts solely to provide those features to you — transcription, clip editing, follow-up suggestions, and question personalization. Nothing else. No marketing use, no training use, no sublicensing beyond those processors.
- You’re responsible for your content. Make sure you have the right to record the people in your videos (see section 6).
4. Subscription, trial, and cancellation
- Price. Bramble’s full features are sold as an auto-renewing subscription: $48.99 per year or $9.99 per month (or the local-currency equivalent shown in the App Store at purchase).
- Free trial. Bramble gives you a 21-day free trial that begins with your first recording. During the trial you can use the app fully without subscribing, and you are not charged. When the trial ends, a subscription is required to record new daily captures — but everything you already recorded stays yours, viewable and exportable, whether or not you subscribe.
- Renewal. If you subscribe, your subscription renews automatically each period unless you cancel at least 24 hours before the current period ends. Apple charges your Apple account at renewal.
- How to cancel. Manage or cancel any time in your device’s Settings → your Apple account → Subscriptions. Deleting the app does not cancel the subscription.
- Refunds. Purchases are processed by Apple, and refunds are handled by Apple under their policies — request one at reportaproblem.apple.com.
- Price changes. If we ever change the price, Apple will notify you and the new price will only apply if you agree or at your next renewal as App Store rules require.
- If your subscription lapses: you keep the app, every recording you’ve made, and free raw export. Subscription-only features (recording new daily captures and AI editing) pause until you resubscribe.
5. Not medical, psychological, or developmental advice
Bramble’s daily questions are written with care and informed by published research on child development and parent–child conversation. That is a promise about how the questions were made — not a promise about your child.
- Bramble is not a medical, psychological, therapeutic, educational, or developmental product, and it is not a substitute for any of those.
- Bramble does not assess, screen, diagnose, treat, or monitor any condition, and makes no claims about outcomes for your child — developmental, academic, emotional, or otherwise.
- Nothing in the app — questions, follow-up suggestions, memory notes, or anything an AI feature generates — is professional advice. AI-generated content can be wrong.
- If you have any concern about your child’s development, speech, or wellbeing, talk to your pediatrician or a qualified professional. Don’t use Bramble (or delay seeking care) in place of that.
6. Acceptable use
You agree to:
- Record only your own child, a child you are the legal guardian of, or a child whose parent or guardian has given permission — and follow any recording-consent laws that apply where you live;
- Use Bramble only for its intended personal, family purpose, and only in lawful ways;
- Not use Bramble to create, store, or share content that is unlawful or exploits or endangers any child;
- Not interfere with, probe, overload, or attempt to gain unauthorized access to the app, the website, or the third-party services it relies on;
- Not misrepresent Bramble’s output as professional assessment or advice.
We may suspend or terminate access (section 10) for serious or repeated violations. Where the law requires it, we will report content involving the endangerment of children to the appropriate authorities.
7. AI features
The AI features are optional and off by default; how they work and where data goes is described in the Privacy Policy, which is part of these terms. Transcripts, clip selections, and suggestions are generated automatically and may contain mistakes — charming ones, usually, but review anything that matters before relying on or sharing it. AI features depend on third-party services (AssemblyAI, Anthropic) and may be interrupted, changed, or discontinued if those services change.
8. Intellectual property
Bramble’s app, website, design, illustrations, question library, and the Bramble name and bluebird mark belong to us and are protected by copyright, trademark, and other laws. Your content remains yours (section 3). Feedback you choose to send us may be used to improve Bramble without obligation to you.
9. Warranty disclaimer
BRAMBLE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED — INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR UNINTERRUPTED OPERATION. WE DO NOT WARRANT THAT THE APP WILL BE ERROR-FREE, THAT TRANSCRIPTS OR AI OUTPUT WILL BE ACCURATE, OR THAT DATA WILL NEVER BE LOST. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
Plain-English footnote: your recordings live on your device, so please keep a backup (Save to Photos, iCloud device backup, or regular exports). A lost or wiped phone can mean lost recordings, and we have no server copy to restore from.
10. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW: (A) WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, RECORDINGS, PROFITS, OR GOODWILL, ARISING FROM OR RELATED TO BRAMBLE; AND (B) OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO BRAMBLE WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM AROSE (OR US $48.99 IF YOU PAID NOTHING). THESE LIMITS APPLY REGARDLESS OF THE THEORY OF LIABILITY AND EVEN IF A REMEDY FAILS OF ITS ESSENTIAL PURPOSE. THEY DO NOT LIMIT LIABILITY THAT CANNOT BE LIMITED BY LAW, INCLUDING LIABILITY FOR GROSS NEGLIGENCE, WILLFUL MISCONDUCT, OR FRAUD. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
11. Termination
You can stop using Bramble at any time — cancel via Apple and delete the app. We may suspend or terminate your access if you materially breach these terms (especially section 6), with notice where practicable. On termination for breach we may revoke the license in section 2; sections that by their nature should survive (3, 5, 9, 10, 13, 14) survive. Termination never takes away your ownership of your recordings or your ability to export what’s on your device.
12. Apple App Store terms
Bramble is distributed through Apple’s App Store, and Apple’s standard terms apply alongside these. In particular: these terms are between you and us, not Apple; Apple has no obligation to provide support or maintenance for Bramble; Apple is not responsible for addressing any claims relating to the app (including product liability, legal compliance, or IP claims); and Apple and its subsidiaries are third-party beneficiaries of these terms, entitled to enforce them against you. You represent that you are not in a country subject to a U.S. government embargo and not on any U.S. government restricted-party list.
13. Governing law and disputes
These terms are governed by the laws of the State of New York, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in New York, and both sides consent to their jurisdiction — except that either side may use small-claims court where eligible, and nothing here limits rights you have under the consumer-protection laws of where you live.
14. Changes to these terms
We may update these terms as Bramble grows. For material changes we’ll update the effective date above and tell you in the app (or by other reasonable notice) before the changes apply. If you keep using Bramble after they take effect, the new terms apply; if you don’t agree, stop using the app and cancel via Apple. No change will retroactively take away your ownership of your content or the free-raw-export promise.
15. The boring-but-necessary bits
- These terms plus the Privacy Policy are the whole agreement between you and us about Bramble.
- If part of these terms is found unenforceable, the rest still stands.
- If we don’t enforce a provision right away, we haven’t waived it.
- You may not assign these terms; we may assign them in connection with a sale or reorganization of the business, with your protections intact.
