The short version

These terms are an agreement between you and the maker of Bramble. By downloading or using the Bramble iOS app or askbramble.com (together, “Bramble”), you agree to them. If you don’t agree, please don’t use Bramble.

1. Who can use Bramble

You must be at least 18 and a parent or legal guardian (or an adult recording with a parent or guardian’s permission). Bramble is a tool for adults; children may appear in your recordings, but they are not users of the app and may not operate it.

2. Your license to use Bramble

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to install and use Bramble on Apple devices you own or control, for your personal, non-commercial family use, in line with these terms and Apple’s App Store terms. We keep all rights not expressly granted. You may not copy, modify, resell, rent, reverse-engineer, or extract the source code of the app, or use Bramble to build a competing dataset or service, except where the law says we can’t stop you.

Bramble’s daily questions are written with care and informed by published research on child development and parent–child conversation. That is a promise about how the questions were made — not a promise about your child.

We may suspend or terminate access (section 10) for serious or repeated violations. Where the law requires it, we will report content involving the endangerment of children to the appropriate authorities.

7. AI features

The AI features are optional and off by default; how they work and where data goes is described in the Privacy Policy, which is part of these terms. Transcripts, clip selections, and suggestions are generated automatically and may contain mistakes — charming ones, usually, but review anything that matters before relying on or sharing it. AI features depend on third-party services (AssemblyAI, Anthropic) and may be interrupted, changed, or discontinued if those services change.

8. Intellectual property

Bramble’s app, website, design, illustrations, question library, and the Bramble name and bluebird mark belong to us and are protected by copyright, trademark, and other laws. Your content remains yours (section 3). Feedback you choose to send us may be used to improve Bramble without obligation to you.

9. Warranty disclaimer

BRAMBLE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED — INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR UNINTERRUPTED OPERATION. WE DO NOT WARRANT THAT THE APP WILL BE ERROR-FREE, THAT TRANSCRIPTS OR AI OUTPUT WILL BE ACCURATE, OR THAT DATA WILL NEVER BE LOST. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

Plain-English footnote: your recordings live on your device, so please keep a backup (Save to Photos, iCloud device backup, or regular exports). A lost or wiped phone can mean lost recordings, and we have no server copy to restore from.

10. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW: (A) WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, RECORDINGS, PROFITS, OR GOODWILL, ARISING FROM OR RELATED TO BRAMBLE; AND (B) OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO BRAMBLE WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM AROSE (OR US $48.99 IF YOU PAID NOTHING). THESE LIMITS APPLY REGARDLESS OF THE THEORY OF LIABILITY AND EVEN IF A REMEDY FAILS OF ITS ESSENTIAL PURPOSE. THEY DO NOT LIMIT LIABILITY THAT CANNOT BE LIMITED BY LAW, INCLUDING LIABILITY FOR GROSS NEGLIGENCE, WILLFUL MISCONDUCT, OR FRAUD. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

11. Termination

You can stop using Bramble at any time — cancel via Apple and delete the app. We may suspend or terminate your access if you materially breach these terms (especially section 6), with notice where practicable. On termination for breach we may revoke the license in section 2; sections that by their nature should survive (3, 5, 9, 10, 13, 14) survive. Termination never takes away your ownership of your recordings or your ability to export what’s on your device.

12. Apple App Store terms

Bramble is distributed through Apple’s App Store, and Apple’s standard terms apply alongside these. In particular: these terms are between you and us, not Apple; Apple has no obligation to provide support or maintenance for Bramble; Apple is not responsible for addressing any claims relating to the app (including product liability, legal compliance, or IP claims); and Apple and its subsidiaries are third-party beneficiaries of these terms, entitled to enforce them against you. You represent that you are not in a country subject to a U.S. government embargo and not on any U.S. government restricted-party list.

13. Governing law and disputes

These terms are governed by the laws of the State of New York, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in New York, and both sides consent to their jurisdiction — except that either side may use small-claims court where eligible, and nothing here limits rights you have under the consumer-protection laws of where you live.

14. Changes to these terms

We may update these terms as Bramble grows. For material changes we’ll update the effective date above and tell you in the app (or by other reasonable notice) before the changes apply. If you keep using Bramble after they take effect, the new terms apply; if you don’t agree, stop using the app and cancel via Apple. No change will retroactively take away your ownership of your content or the free-raw-export promise.
